Practice Areas

The Law Offices of Terri A. Georgen has broad legal experience capable of getting results for clients. The firm's areas of expertise include the following:

Bankruptcy-At the core of our nation's bankruptcy laws is the notion that honest, financially strapped citizens should be given the opportunity for a "fresh start" in life. Bankruptcy holds out a promise to the debtor of a new opportunity in life and a clear field for future effort, unhampered by the pressure and discouragement of pre-existing debt. We represent individual and commercial clients in Chapter 7 liquidation cases, Chapter 11 reorganization cases, and Chapter 13 rehabilitation cases. We bring experience, skill, and creativity to the highly complex area of bankruptcy law. Our firm has the capacity and flexibility to handle every type of bankruptcy proceeding.

Financial Services and Collection-The firm represents banks and financial institutions in a wide array of matters including regulatory services, loan documentation, banking litigation, lender liability defense, foreclosures, receiverships, collection and pre-judgment remedies, pre-bankruptcy workouts and bankruptcies. The firm coordinates its efforts and expertise with other business and securities, real estate and bankruptcy attorneys to provide comprehensive and cost-efficient service to all financial institutions, banks, asset-based lenders, lessors and other financial intermediaries.

Creditor's Rights, Insolvency & Bankruptcy-The firm represents debtors, creditors, and interested parties in court proceedings at the state and federal level, in out-of-court workouts, and in federal bankruptcy cases. The firm assists insolvent businesses and select individuals in their efforts to discharge or restructure existing liabilities and obligations. The firm also represents creditors in a wide range of contexts, including collection litigation, judgment enforcement, voluntary and involuntary bankruptcy proceedings, and workouts. The firm serves national and international clients and has expertise assisting in matters involving receiverships. It takes a practical approach to bankruptcy and creditor/debtor rights, recognizing the cost and risk of litigation, and the significant value of a speedy resolution of disputes. The firm begins with a thorough review of the loan, sale, or lease transaction involved, analyzing credit and collateral risks, the possibility of counterclaims, defenses, and the likelihood of a timely and cost effective litigation remedy. The firm's legal team then develops and implements a litigation strategy, while simultaneously pursuing reasonable negotiated settlements. The firm believes our approach of pursuing both litigation and appropriate negotiation strategies, maximizes benefits to clients, while reducing both legal expense and litigation risks.

Fair Debt Collection Practice Act-The Fair Debt Collection Practice Act (15 USCA 1692) was passed by Congress to eliminate unfair practices and to ensure that debt collectors who refrain from using abusive, deceptive or unfair debt collection practices are not competitively disadvantaged. The firm has extensive experience advising individual and business clients in terms of compliance, and routinely provides legal advice as to the proper form and substance of communications, as well as issues such as harassment, oppression, abuse, false, deceptive or misleading information, notice requirements, and unfair trade practices.
